I for myself, my heirs and executors ACKNOWLEDGE and AGREE: -

1. That I am fully aware of the nature and purposes of the activities of Exiles Gaming and Roleplaying Club Inc (“Exiles”), and I have ensured any minor under my care is aware of same.

2. That I understand that some activities of Exiles may be constrained by local laws and I shall take personal responsibility for ensuring myself and any minor under my care learn and follow those laws

3. That I voluntarily accept the risks involved.

4. That I shall be wholly responsible at all times for my actions, and for the actions of any minor under my care.

5. I shall obey, and ensure any minor under my care obey, the proper direction of all officials of Exiles and that I, and any minors under my care may be excluded from participating for failure or refusal to do so.

6. That I acknowledge that the consumption of alcohol increases risk, and I take full responsibility for any injury, loss, or damage associated with its consumption. I will ensure that any minor under my care will not consume alcohol.

7. That I, and any minor under my care will not participate in any activities that I, or a minor under my care is not appropriately authorised to participate in.

8. That I shall indemnify and keep indemnified Exiles and all members thereof, whether officials or not, from and against all claims, actions, proceedings and demands of whatever kind relating to any injury, loss or damage whatsoever and howsoever caused to myself, or any minor under my care’s person or property arising out of or in connection with attendance at or participation in any activity of Exiles.

9. That I understand the purpose and the effect of this document.

10. That I am over 18 years of age.

11. That I have read and understood of Exiles Incorporated’s Code of Conduct

12. I agree to adhere to the constitution of Exiles and by all valid resolutions passed by the Association. I agree to work within the boundaries of the Associated Incorporation Act 2009 and Regulations 2016 and adhere to Exiles Code of conduct.

14. When buying an item, plan, or service you agree that: (i) you are responsible for reading the full description before making a commitment to buy it: (ii) you enter into a legally binding contract of purchase when you complete the check-out payment process. (iii) If you have signed up for an annual membership subscription, you may not cancel the subscription before the end of term, unless local law requires us to give you the option to cancel, such as under ACCC guidelines. Outside of this you may make an appeal to the committee for special dispensation, with a nominal cancellation fee [of 50% of the remaining balance for the term]. Contact secretary@exiles.club

15. To the maximum extent permitted by applicable law, in no event shall Exiles, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

16. We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

17. We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

18. We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

19. I agree to the entrance fee and subscription.

20. I am aware that unless otherwise stated, my details above will be published in the Club Register, which is available to Club members only, I undertake not to supply other members’ details to non-members or organisations.
